Asheville City Council Agenda 1.24.12

Your Asheville City Council comes together this Tuesday for another session of deliberation and decision-making. Over the fold you’ll find the agenda, and if you click here you can see it with all supporting documents at the City website.

Please let me know your questions, suggestions, opinions, and harangues in the comments section. As usual, it’s best to do that before Council decides.

Some highlights upcoming include: Proposed ordinances to create a permitting process for camping, movement on the Reed Creek Greenway, proposal to rezone a parcel in South Asheville to high density, amendment to the standards regulating push carts and encroachments on public sidewalks, report from the Ethnic Minority Business Alliance.

I. PROCLAMATIONS:
- Proclamation proclaiming February, 2012, as “Black History Month”

II. CONSENT AGENDA:
A. Approval of the minutes of the formal meeting held on January 10, 2012.

B. 1. Resolution authorizing the City Manager to enter into a professional service agreement with Brown and Caldwell for the Water Resources Main Transmission Line Evaluation Project.

2. Budget amendment, in the amount of $219,018, from savings in the Viewmont Acres Waterline Project, for the Water Resources Main Transmission Line Evaluation Project.

C. Resolution authorizing the City Manager to enter into an agreement with T & K Utilities, Inc., for the Water Resources Water Service Renewals Project.

D. Resolution the City Manager and/or Mayor to apply for and, if awarded, enter into a grant agreement with the State of North Carolina for funding of land acquisition for Reed Creek Greenway Phase IV.

E. Resolution of intent to close a portion of South Pack Square and setting a public hearing on February 28, 2012.

F. Resolution authorizing the City Manager to execute an amended contract with AMEC (MACTEC) to provide additional special inspection and construction materials testing for the parking garage at 51 Biltmore Avenue.

G. Resolution amending the City Council 2012 meeting schedule to include the City Council retreat on February 4, 2012, beginning at 9:00 a.m. at UNC-Asheville in the Wilma M. Sherrill Center.

H. Resolution authorizing the City Manager to enter into a Lease Agreement with the Housing Authority of the City of Asheville for a portion of real property known as the W.C. Reid Center, located at 133 Livingston Street.

I. Resolution granting Progress Energy a utility easement over city property at the William DeBruhl Water Treatment Plant.

J. Auditing Services
1. Resolution amending Resolution No. 12-11 authorizing the Mayor to amend the contract with Dixon Hughes Goodman LLP for auditing services for Fiscal Year 2010-11.
2. Resolution amending Resolution No. 12-12 authorizing the Mayor to execute a contract with Dixon Hughes Goodman LLP for auditing services for Fiscal Year 2011-12.

K. Ordinance changing the speed limit on portions of South French Broad Avenue, Soco Street, Shady Oak Drive, Belmont Avenue, Brownwood Avenue, Hanover Street, Manila Street, Stonebridge Drive, and Vanderbilt Park Drive to 25 miles per hour.

L. Ordinance changing the speed limit on portions of Schenck Parkway, Columbine Road, Dearborn Street, East Schenck Crescent, Stamford Street, Thetford Street, Town Square Boulevard, and Walterstone Road in Biltmore Park, South Asheville. Additionally, the ordinance will enact a speed limit on Crowningway Drive and Cummins Road in East Asheville and University Heights in North Asheville to 20 miles per hour.

M. Resolution authorizing the City Manager to execute an amendment to the professional services contract with Betsch Associates/PBC+L for additional design services related to the Civic Center renovations.
N. Budget amendments:
1. In the Housing Trust Fund, in the amount of $412,672, from sale of land and Housing Trust Fund reserves to fully budget planned expenditures for Fiscal Year 2011-12.

2. In the amount of $254,500, from proceeds received from the disposition of real property known as the W.C. Reid Center located at 133 Livingston Street.

3. In the amount of $38,207, to appropriate funds from a letter of credit from Mountain 1st Bank & Trust to complete the construction of the Mill Creek Condominium project.

A. Public hearing to consider a conditional zoning request for White Oak Grove Apartments, located at 275 and 281 Hazel Mill Road, from RM-8 Residential Multi-Family Medium Density District to RM-16 Residential Mulit-Family High Density District/Conditional Zoning for the development of 92 apartment units housed in three buildings.

B. Public hearing to consider rezoning 12 Schenck Parkway from Central Business District to Highway Business District.

C. Public hearing to consider rezoning 2 Gerber Road from Urban Village District to Community Business II District.

V. UNFINISHED BUSINESS:
A. Regulating the use of City property:
1. Ordinance regulating certain uses on City property.
2. Resolution designating Pack Square and City County Plaza as City Parks, and designating certain areas for camping and public forum purposes
3. Ordinance amending the Fees & Charges Manual creating a permit fee for camping associated with free speech.

VI. NEW BUSINESS:
A. Resolution of Consideration identifying aras with potential for future annexation and reducing current map of consideration.

B. Ordinance amending Chapter 16 of the Code of Ordinances concerning changes to the standards regulating pushcarts and encroachments on public sidewalks.

D. Resolution appointing a member to the Greenway Commission.

How is this under Unfinished Business? The ordinances were set aside, I guess, but, wouldn’t a rewrite be new business? Does the rewrite return to the safety committee for further public discussion? Will it be voted on Tuesday, or just discussed?

I guess you can tell I’m not a good candidate for writing compelling political posts for ScruHoo, when I don’t even know the protocol ;-)

If our Government is of the people, for the people, and by the people then why is our Government taking from the people? Why is our Government constantly trying to stop the people from gathering and sharing information? What does our Government wish to cover up? Why was the information that exposed the corruption in our local Government silenced? This attempt to “charge” for Free Speech is another attempt by local officials to silence the people.

Who is responsible for arresting innocent people in their over zealous attempt to discredit, undermine, and punish? Occupy Asheville wants to educate the public concerning corruption, misuse of power, and financial culpability, among other important things for survival in these economic times.

The Government TV stations are funded by twice the funds allotted for the people’s public access. With Asheville and Buncombe County receiving over Three Million in video sales tax and PEG (Public, Education, Government) revenues in 2011, how can we honestly say there was no funding for the people? Buncombe County reported an excess of $300,000 in the General Fund. Money that should have been honored by contract for public access.

In our public access station at Western North Carolina Community Media Center, we the public had a place to assemble in order to communicate with the rest of our Community. There were people who had jobs and were starting small businesses at URTV. Let’s finally get the truth out. URTV, was Not mismanaged, seven audits in five years proved that.

We The People Want To Gather and Communicate with each other. If our Government does not listen to the people speak then they need to resign the position they were elected to fill.
