AFFORDABLE HOUSING IS ONE PART OF AN INTEGRATED APPROACH TO PLANNING. CREATE
TRANSIT CORRIDOR OVERLAY DISTRICTS THAT ENCOURAGE AFFORDABLE HOUSING BY
PROVIDING INCENTIVES FOR MIXED USE DEVELOPMENT, HIGHER DENSITY, SUSTAINABILITY,
INFILL DEVELOPMENT AND OPEN SPACE. POTENTIAL AREAS FOR THE TRANSIT CORRIDOR
OVERLAY DISTRICTS ARE: PATTON AVENUE IN WEST ASHEVILLE, MERRIMON AVENUE IN
NORTH ASHEVILLE, TUNNEL ROAD IN EAST ASHEVILLE, AND HENDERSONVILLE ROAD AND,
SWEETEN CREEK ROAD IN SOUTH ASHEVILLE.

Regular Meeting -  January 12, 2010 – 5:00 p.m.

The following has been set as the tentative agenda for the January 12, 2010, regular meeting of the City Council.  Information regarding City employees is governed by N.C. Gen. Stat. sec. 160A-168 – Council does not consider personnel matters in open session.  At the conclusion of this agenda the meeting will be open for the presentation of other matters by members of Council and the public.  Public comment will not be taken on items as to which no Council action will be taken at this meeting, including those items listed as reports or presentations or as discussion items.  When Council action is anticipated as to any matter, it will be placed on a Council agenda for consideration and public comment will be taken at that time.

I.   PROCLAMATIONS:

-          Recognition of A.C. Reynolds Football Team Winning the State 4-A Championship

-          Proclamation proclaiming January 14-18, 2010, as “Dr. Martin Luther King Jr. Weekend”

II.  CONSENT AGENDA:

A.        Approval of the minutes of the formal meeting held on December 15, 2009, meeting.

B.        Budget amendment, in the amount of $1,000, from a Court-ordered action, to the Police/

Patrol Division’s Special Purpose Fund for the purpose of investigative costs.

C.        Resolution authorizing the City Manager to sign a service agreement with Hersey

Meters Co. LLC, for the five-year automated meter reading project.

III.  PRESENTATIONS AND REPORTS:

A.        H1N1 Preparedness for Community Update

B.        Presentation of the Fiscal Year 2009 Comprehensive Annual Financial Report.

C.        After Action Storm Briefing

D.         Economic Stimulus Package Update

-   Budget amendment, in the amount of $804,700, from the Energy Efficiency and

Conservation Block Grant, for Energy  Efficiency Retrofits and implementing

components of the Sustainability Management Plan.

CITY COUNCIL HAS ESTABLISHED THE FOLLOWING TIME LIMITS FOR PUBLIC HEARINGS:

· APPLICANTS HAVE UP TO TEN MINUTES TO COMPLETE A PRESENTATION.

· ELECTRONIC PRESENTATIONS ARE LIMITED TO AGENDA ITEMS WITH
PRESENTATION MATERIALS PROVIDED PRIOR TO THE MEETING BY CITY
STAFF, APPLICANTS, OR ORGANIZED OPPOSITION.

· INDIVIDUALS HAVE UP TO THREE MINUTES TO SPEAK TO CITY COUNCIL.

· A PERSON REPRESENTING A GROUP OF THREE OR MORE PERSONS
(NOT INCLUDING THE SPEAKER) PRESENT IN THE COUNCIL CHAMBER
HAS UP TO 10 MINUTES TO ADDRESS CITY COUNCIL.

· PUBLIC COMMENT PERIOD FOR ANY ITEM MAY NOT EXCEED ONE HOUR.

· ADDITIONAL INFORMATION MAY BE PROVIDED IN HARD COPY AND/OR WRITTEN FORM.

IV.  PUBLIC HEARINGS:

A.     Public hearing to consider an amendment to the conditional use permit for the Glen

Rock mixed use development (formerly identified as Depot and Ralph Streets)

located at 362, 372 and 403 Depot Street, in order to amend the mix of uses proposed

in Phase III of the project and to revise the approved landscape plan.

B.    Public hearing to consider a conditional use permit for the project identified as Mission

Outpatient Cancer Center located at Hamilton Street for a 229,521 square foot medical

bulding and parking deck, with a request to reduce the required number of parking

spaces.

C.    Stormwater and Erosion Control Ordinance

-   Public hearing to amend Chapter 7 of the Code of Ordinances pertaining to

environmental protection standards for soil erosion and sedimentation control and

stormwater management.

-   Public hearing to amend Chapter 7 of the Code of Ordinances pertaining to

definitions of the environmental protection standards.

-   Public hearing to amend Chapter 7 of the Code of Ordinances pertainng to

enforcement of the stormwater and soil erosion provisions.

V.  UNFINISHED BUSINESS:

A.        Discussion of various strategies proposed in the Downtown Master Plan related to

project review processes.

B.        Asheville Energy Independence Initiative.

C.        Six-Month review of the Roadside Solicitation Policy.

VI.  NEW BUSINESS:

Gordon, you know these links don’t work, right? You have to go to the city website to access them.

And it’s worth it – I just had a good laugh. Guess who is applying for seats on the Downtown Commission, which has a huge role in approving development projects… Tony Fraga himself. And on the same day, Henry Watts, a Vice President from Beverly-Grant, a local construction company sure to be on the short list if Fraga ever gets his ginormous project going.

Such cajones, it is to wonder.

Dear Councilman Smith,

Any chance we could move City Council meetings to Monday? American Idol premieres next week and sometimes when y’all blather on for too long, it cuts into my viewing time. I think I speak for the majority of citizens on this issue. Either that or move public comment to the top of the agenda so we don’t miss the good stuff. Thank you for your consideration.
